Service Agreement

Terms & Conditions

Last updated: October 2026 • Effective Date: October 2026

1. Acceptance of Terms & Merchant of Record

By accessing our website (https://mytimtim.com), submitting an inquiry form, or subscribing to TimTim services, you (“Merchant” or “Client”) agree to be bound by these Terms and Conditions (“Terms”).

TimTim is operated by MYTIMTIM LLC, 205 New Dover Road, Colonia, NJ 07067 (“TimTim”, “we”, “our”, or “us”).

Merchant of Record Disclosure:

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle handles billing, taxes, payment processing, invoices, and refunds. This agreement sits alongside Paddle's Buyer Terms and Refund Policy.

2. Scope of Services

TimTim provides mobile app software development, design, and technical integration services that convert eCommerce stores (Shopify and WooCommerce) into native mobile applications for iOS and Android. Our services include:

  • Design and configuration of mobile applications customized to match your store branding.
  • Real-time catalog synchronization of collections, products, inventory, customer accounts, and checkout flows.
  • Packaging, compilation, and testing of your application builds, and step-by-step guidance through submission to the Apple App Store and Google Play Store. The Merchant submits applications, and subsequent updates, from the Merchant's own developer accounts.
  • Ongoing maintenance, operating system compatibility updates, and API maintenance. Updates that require store resubmission are prepared and tested by TimTim and submitted by the Merchant.

3. Subscriptions, Fees & Billing

Subscription Plans: Services are billed on a recurring monthly or annual basis as selected during onboarding ($39.99/month per platform; $74.99/month for the iOS and Android bundle).

Setup Fees: Any applicable setup fees (standard $399 USD, currently zero for a limited time) are billed at the time of initial order placement through Paddle.

Cancellation: You may cancel your subscription at any time through the “manage subscription” link in your Paddle receipt email or by contacting us. When you cancel, your subscription remains active until the end of the current billing cycle. After cancellation, your published app remains live in the stores under your developer accounts, but active catalog synchronization ceases and your app receives no further updates.

Refunds: All purchases are governed by our Refund Policy, which includes a 30-day money-back guarantee on your first payment and a 14-day refund window on renewal charges.

Third-Party Developer Fees: The Merchant must publish applications under the Merchant's own developer accounts (Apple Developer Program $99/year; Google Play Console $25 one-time fee). Third-party developer program fees levied directly by Apple or Google are paid directly to Apple and Google by the Merchant.

4. App Store Review & Approval

TimTim builds all applications strictly to Apple's and Google's published developer guidelines and review criteria. If review feedback or questions arise during store review, our team guides you through the necessary adjustments and resubmissions.

Final app store review and approval decisions are made solely at the discretion of Apple and Google and cannot be guaranteed by any third party. If you are unsatisfied during the initial build and review phase, your purchase remains protected under our 30-day money-back guarantee described in our Refund Policy.

5. Intellectual Property & License to Merchant

Merchant Ownership

You retain 100% full and exclusive ownership and control of your trademarks, brand assets, logos, product catalogs, customer records, store content, Apple and Google developer accounts, and store listings.

TimTim Proprietary Code

TimTim retains all rights, title, and intellectual property in the underlying mobile software architecture, code libraries, templates, sync algorithms, and integration APIs.

License Grant to Merchant

TimTim grants the Merchant a non-exclusive, revocable, non-transferable license to use, publish, and distribute the mobile application compiled for the Merchant while your subscription is active. Upon subscription cancellation, refund, or termination, your license to TimTim's synchronization services and ongoing code maintenance ceases. Your published app remains live under your store accounts, but stops syncing with your store.

6. Acceptable Use & Prohibited Conduct

The Merchant agrees and warrants that you will not use TimTim's software or services to:

  • Violate any applicable local, national, or international laws, regulations, or consumer protection statutes.
  • Sell, promote, or distribute counterfeit products, illegal substances, fraudulent schemes, or prohibited goods.
  • Infringe upon the intellectual property, privacy, or proprietary rights of any third party.
  • Attempt to reverse-engineer, decompile, disassemble, extract source code, or create derivative works from TimTim's software frameworks.
  • Transmit malicious code, viruses, or automated scripts designed to disrupt, overload, or compromise our systems or APIs.
  • Violate Apple App Store Review Guidelines or Google Play Developer Program Policies.

TimTim reserves the right to immediately suspend or terminate services if a Merchant violates these acceptable use standards.

7. Service Availability & Disclaimer of Warranties

The services and software are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

While TimTim strives for high reliability and uptime, we do not warrant that the services or mobile app operation will be completely uninterrupted, timely, secure, or error-free. TimTim shall not be liable for disruptions, downtime, or delays resulting from third-party platforms outside our control, including Shopify, WooCommerce, Apple App Store, Google Play, internet service providers, or payment gateway outages.

8. Suspension and Termination

Either party may terminate the subscription agreement at any time in accordance with Section 3.

TimTim reserves the right to suspend or terminate your account and access to services immediately, with or without notice, if: (a) you fail to pay recurring subscription fees; (b) you materially breach any provision of these Terms; (c) your store engages in fraudulent or illegal conduct; or (d) Apple or Google terminates your developer account.

Upon termination or cancellation, active synchronization and software update preparation will cease immediately.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall MYTIMTIM LLC, its directors, employees, or partners be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, data, or business goodwill.

Our total aggregate liability arising out of or relating to these Terms or the services shall not exceed the total amount paid by the Merchant to TimTim during the twelve (12) months preceding the incident giving rise to the claim.

10. Governing Law & Dispute Resolution

These Terms and your use of the Services are governed by and construed in accordance with the laws of the State of New Jersey and the federal laws of the United States of America, without regard to conflict of law principles. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the federal or state courts located in New Jersey, United States of America.

11. Modifications to Terms

We reserve the right to revise these Terms periodically. When changes are made, we will update the “Last updated” date at the top of this document. Continued use of TimTim services following notice or publication of revised Terms constitutes your acceptance of the updated terms.
